Panelists:
Paige D. Waters, Partner, Troutman Pepper Locke LLP
Stephanie O’Neill Marco, Counsel, Troutman Pepper Locke LLP

This program will examine how emerging AI tools intersect with the unique fiduciary, statutory, and ethical obligations of insurance receivers. The presentation first introduces core AI technologies and current insurance industry use cases, then situates potential receivership applications—such as claims review, communications, portfolio analysis, and litigation support—within the receiver’s heightened duties of competence, loyalty, transparency, fairness, and confidentiality.

Using a five-pillar ethical framework and practical hypotheticals involving AI-assisted claim classification, predictive distribution modeling, and avoidance-action discovery, the program explores risks such as inaccuracy, bias, “hallucinations,” and data security. It will address how these risks must be managed through human oversight, verification protocols, disclosure to courts and stakeholders, and robust governance policies.

The session concludes with a discussion of emerging bar, regulatory, and NAIC guidance and offers concrete best-practice recommendations and an implementation framework to help receivers adopt AI responsibly, ethically, and in alignment with court supervision and public-interest obligations.
